This case is about whether polytheists can enter the Sacrosanct Mosque or be fought there. The verse in question is

And it is claimed to have been abrogated partially or fully by any of three verses,




Ibn Al-Jawzi wrote about it in detail as follows,

باب ذكر الآيات اللواتي ادعي عليهن النسخ في سورة المائدة. قد زعم قوم أنه ليس في المائدة منسوخ، فأخبرنا محمد بن أبي منصور قال أبنا علي بن أيوب قال أبنا أبو علي بن شاذان قال أبنا أبو بكر النجاد قال أبنا أبو داود السجستاني قال بنا محمد بن بشار قال بنا عبد الرحمن قال بنا إسرائيل عن أبي إسحاق عن عامر بن شراحيل قال: المائدة ليس فيها منسوخ. قال ابن بشار وبنا بن أبي عدي قال بنا ابن عون قال قلت للحسن: نسخ من المائدة شيء؟ قال: لا. وقد ذهب الأكثرون إلى أن في المائدة منسوخا ونحن نذكر ذلك.

ذكر الآية الأولى: قوله تعالى "يا أيها الذين آمنوا لا تحلوا شعائر الله ولا الشهر الحرام ولا الهدي ولا القلائد ولا آمين البيت الحرام" الآية. اختلف المفسرون في هذه الآية هل هي محكمة أم منسوخة على قولين:
القول الأول أنها محكمة ولا يجوز استحلال الشعائر ولا الهدي قبل أوان ذبحه ثم اختلفوا في القلائد فقال بعضهم يحرم رفع القلادة عن الهدي حتى ينحر، وقال آخرون منهم كانت الجاهلية تقلد من شجر الحرم فقيل لهم لا تستحلوا أخذ القلائد من الحرم ولا تصدوا القاصدين إلى البيت.
والقول الثاني أنها منسوخة ثم في المنسوخ منها ثلاثة أقوال:
الأول قوله "ولا آمين البيت الحرام" فإن هذا اقتضى جواز إقرار المشركين على قصدهم البيت وإظهارهم شعائر الحج، ثم نسخ هذا بقوله "فلا يقربوا المسجد الحرام بعد عامهم هذا"، وبقوله "فاقتلوا المشركين حيث وجدتموهم"، وهذا المعنى مروى عن ابن عباس رضي الله عنهما. أخبرنا إسماعيل بن أحمد قال أبنا عمر بن عبيد الله قال أبنا ابن بشران قال أبنا إسحاق بن أحمد قال أبنا عبد الله بن أحمد قال حدثني أبي قال بنا عبد الوهاب عن سعيد عن قتادة قال: نسخ منها "آمين البيت الحرام" نسخها قوله "فاقتلوا المشركين حيث وجدتموهم"، وقال "ما كان للمشركين أن يعمروا مساجد الله شاهدين على أنفسهم بالكفر"، وقال "إنما المشركون نجس فلا يقربوا المسجد الحرام بعد عامهم".
والثاني أن المنسوخ منها تحريم الشهر الحرام وتحريم الآمين للبيت إذا كانوا مشركين وهدي المشركين إذا لم يكن لهم من المسلمين أمان قاله أبو سليمان الدمشقي.
والثالث أن جميعها منسوخ. أخبرنا المبارك بن علي قال أبنا أحمد بن الحسين بن قريش قال أبنا إبراهيم بن عمر البرمكي قال أبنا محمد بن إسماعيل بن العباس قال أبنا أبو بكر بن أبي داود قال بنا يعقوب بن سفيان قال بنا أبو صالح قال بنا معاوية بن صالح عن علي بن أبي طلحة عن ابن عباس رضي الله عنهما "لا تحلوا شعائر الله ولا الشهر الحرام ولا الهدي ولا القلائد ولا آمين البيت الحرام"، قال: كان المشركين يحجون البيت الحرام ويهدون الهدايا ويحرمون حرمة المشاعر وينحرون في حجهم فأنزل الله عز وجل "لا تحلوا شعائر الله ولا الشهر الحرام" أي لا تستحلوا قتالا فيه "ولا آمين البيت الحرام" يقول من توجه قبل البيت ثم أنزل الله فقال "فاقتلوا المشركين حيث وجدتموهم". أخبرنا إسماعيل بن أحمد قال أبنا عمر بن عبيد الله قال أبنا ابن بشران قال أبنا إسحاق بن أحمد قال بنا عبد الله بن أحمد بن حنبل قال حدثني أبي قال بنا يزيد قال أبنا سفيان بن حسين عن الحكم عن مجاهد قال: نسخت هذه الآية "لا تحلوا شعائر الله" نسختها "فاقتلوا المشركين حيث وجدتموهم". قال أحمد وبنا عبد الرزاق قال بنا معمر عن قتادة "لا تحلوا شعائر الله ولا الشهر الحرام ولا الهدي ولا القلائد"، قال هي منسوخة كان الرجل في الجاهلية إذا خرج من بيته يريد الحج تقلد السمر فلم يعرض له أحد، فإذا رجع تقلد قلادة شعر فلم يعرض له أحد، وكان المشرك يومئذ لا يصد عن البيت فأمروا أن لايقاتلوا في الشهر الحرام ولا عند البيت الحرام فنسخها "فاقتلوا المشركين حيث وجدتموهم". أخبرنا ابن الحصين قال أبنا ابن غيلان قال أبنا أبو بكر الشافعي قال أبنا إسحاق بن الحسن قال أبنا أبو حذيفة النهدي قال بنا سفيان الثوري عن بيان عن الشعبي قال لم ينسخ من المائدة غير آية واحدة "يا أيها الذين آمنوا لا تحلوا شعائر الله ولا الشهر الحرام "نسختها "فاقتلوا المشركين حيث وجدتموهم" وفصل الخطاب في هذا أنه لا يمكن القول بنسخ جميع الآية فإن شعائر الله أعلام متعبداته ولا يجوز القول بنسخ هذا إلا أن يعني به لا تستحلوا نقض ما شرع فيه المشركون من ذلك فعلى هذا يكون منسوخا، وكذلك الهدي والقلائد وكذلك الآمون للبيب فإنه لا يجوز صدهم إلا أن يكونوا مشركين وأما الشهر الحرام فمنسوخ الحكم على ما بينا في قوله "يسألونك عن الشهر الحرام قتال فيه". فأما قوله "وإذا حللتم فاصطادوا" فلا وجه لنسخه وأما قوله "ولا يجرمنكم شنآن قوم" فمنسوخ بقوله "فاقتلوا المشركين حيث وجدتموهم"، وباقي الآية محكم بلا شك


The claim of abrogation here is that the part that says, "And do not let the hatred of a people for having obstructed you from the Sacrosanct Mosque lead you to transgress" regards the polytheists coming to the Mosque for whatever purpose, is it permissible to fight them there? This is the same case as 2:217 we discussed in this post. The argument to refute this claim here is the same one used there, namely, fighting at the Sacrosanct Mosque (or during the Sacrosanct months) is forbidden unless the enemy fights us there or then.

Now, the next argument presented in Ibn Al-Jawzi's discussion above is this: What if a polytheist goes to the Sacrosanct Mosque for pagan pilgrimage, for instance, can Muslims let him enter? The answer is no, of course, according to 9:17 and 9:28. But that is no cause to claim that 5:2 is abrogated, because 5:2 starts out by saying we should not allow that! So, where is the conflict? Where in 5:2 does God say that it is OK to let the polytheists in the Sacrosanct Mosque?

Good point. Why do people claim abrogation without identifying what exactly is being annulled?

BTW, the role of Chapter 9 ("التوبة" or "براءة" as it is sometimes called) in expanding the abrogation doctrine and in other fundamental questions is paramount. The timing of the revelation (all at once, not long before the Prophet PBUH died), and the very strong language in it in terms of fighting the disbelievers in the Arabian peninsula, suggest something to me. IMHO, the main role of this chapter was to give Abu-Bakr the authority, the assurance, and the political capital to fight "حروب الردة" (the wars against those who reverted back to disbelieving once the Prophet died) as he needed stronger mandate once the authoritative figure of the Prophet was no longer there.

That's a very clever viewpoint and quite plausible. Unfortunately, some people have taken a Carte Blanche authority from the chapter, and especially from the fifth verse.

Brief translation:
Aamir ibn Shuraaheel (Ash-Sha`bi) said there are no abrogated verses in Chapter 5. Ibn Awn asked Al-Hasan, "Anything abrogated in Al-Maa'ida (Chapter 5)?" He said no. But the majority said there are abrogated verses in Al-Maa'ida and we (Ibn Al-Jawzi) 'mention' that. (This may have been a typo and what he meant to write is ننكر which means 'we deny that.')

In his book, فتح المنان في نسخ القرآن, Ali Hasan Al-Areedh, quotes Aa'isha, may God have been pleased with her, saying that Chapter 5 was the last revealed chapter of the Quran, and that is why some scholars believe that it cannot possibly contain any abrogated verses.

Dr. Mustafa Zayd lists this claim as one of those famous for being abrogated but actually isn't. He discusses it and refutes in his book النسخ في القرآن الكريم, volume 2, pages 276-282 (items 1173-1184). He knocks down At-Tabari's arguments one after the other. One of those arguments is that At-Tabari interprets القلائد means the pendants that the Arabs used to wear around their necks during the pilgrimage season. Those pendants were simple locks of hair. The convention was that if someone was wearing those, he could not be harmed.

Dr. Zayd says that this interpretation does not hold, since القلائد has acquired a new meaning after Islam, namely pendants marking animals designated for sacrifice during the pilgrimage season. A claim of abrogation cannot rest on one particular interpretation, when another interpretation exists which leads to a conclusion of no abrogation.

In discussing this abrogation claim, Abu-Abdillah Shu`la, in his book صفوة الراسخ في علم المنسوخ والناسخ, pages 130-131, says the following (my translation),
"What God has ordered His worshipers of obedience and acts of goodness, He has forbidden them to contradict Him in them or to transgress what He has commanded them to do. That is not abrogated."

Very true. Shu`la says that as he rejects this abrogation claim. But doesn't this rule apply to all abrogation claims?

Dehlvi dismisses this claim, in his book الفوز الكبير في أصول التفسير, pages 63-64, on the basis that fighting in the sacred month is a major thing unless it has to be done, e.g., to defend Muslims against enemy attacks or to stop religious persecution.

He makes an excellent point when he refers to the last sermon of the Prophet (PBUH) where he emphasized the sanctity of the sacred months.
