Of the verses claimed abrogated by the sword verse is

as Ibn Al-Jawzi reports,

باب ذكر ما ادعي عليه النسخ في سورة محمد صلى الله عليه وسلم. ذكر الآية الأولى: قوله تعالى "فإما منا بعد وإما فداء". فيها قولان: الأول أنها محكمة وأن حكم المن والفداء باق لم ينسخ، وهذا مذهب ابن عمر والحسن وابن سيرين ومجاهد وأحمد والشافعي. والثاني أن المن والفداء نسخ بقوله "فاقتلوا المشركين حيث وجدتموهم"، وهذا مذهب ابن جريح والسدي وأبي حنيفة. أخبرنا عبد الوهاب قال أنبا أبو الفضل بن خيرون وأبو طاهر الباقلاوي قالا أبنا ابن شاذان قال أبنا أحمد بن كامل قال حدثني محمد بن سعد قال حدثني أبي قال حدثني عمي عن أبيه عن جده عن ابن عباس "فإما منا بعد وإما فداء" قال الفداء منسوخ نسختها "فاقتلوا المشركين حيث وجدتموهم". أخبرنا ابن ناصر قال أبنا ابن أيوب قال أبنا ابن شاذان قال أبنا أبو بكر النجاد قال ابنا أبو داود السجستاني قال بنا ابن السرح قال حدثني خالد بن بزار قال حدثني إبراهيم بن طهمان عن حجاج بن الحجاج الباهلي عن قتادة "فإما منا بعد وإما فداء" قال: كان أرخص لهم أن يمنوا على من شاؤا ويأخذوا الفداء إذا أثخنوهم ثم نسخ فقال "فاقتلوا المشركين حيث وجدتموهم". أخبرنا إسماعيل بن أحمد قال أبنا عمر بن عبيد الله قال أبنا ابن بشران قال أبنا إسحاق بن أحمد قال بنا عبد الله بن أحمد قال حدثني أبي قال بنا عبد الوهاب عن سعيد عن قتادة "فإما منا بعد وإما فداء" قال: نسخ ذلك في براءة "فاقتلوا المشركين حيث وجدتموهم" قال أحمد وبنا عبد الصمد عن همام عن قتادة قال رخص له أن يمن على من يشاء منهم الفداء ثم نسخ ذلك بعد في براءة فقال "فاقتلوا المشركين حيث وجدتموهم". قال أحمد وبنا حجاج قال بنا سفيان قال سمعت السدي قال "فإما منا بعد وإما فداء" قال نسختها "فاقتلوا المشركين حيث وجدتموهم". قال أحمد وبنا معاوية بن عمرو قال أبنا أبو إسحاق عن سفيان عن ليث عن مجاهد أنه قال: هي منسوخة لا يفادون ولا يرسلون قال أحمد وبنا حجاج قال بنا شريك عن سالم عن سعيد قال: يقتل أسرى الشرك ولا يفادون حتى يثخن فيهم القتل

The claim is made by Qataada and Mujaahid (in one report) and agreed to by Ibn Jurayh, As-Suddi and Abu-Haneefa. However, Ibn Umar, Al-Hasan, Ibn Seereen, Mujaahid (in another report), Ahmad and Ash-Shaafi`i all said it was not abrogated and the pardon and ransom options remain in effect.

Neither side say why and Ibn Al-Jawzi offers no opinion. Abu-Abdillah Shu`la, in his book صفوة الراسخ في علم المنسوخ والناسخ, page 174, tells that Ad-Dhahhaak, `Ataa' and Al-Hasan have argued the reverse: that 47:4 abrogated the option to kill POWs which they said 9:5 allowed. Where did 9:5 allow killing POWs?

Shu`la also tells that the majority of exegetes have said that neither of the two verses is abrogated and that what to do with a prisoner of war is left to the ruler to decide based on what is in the best interest. I agree, but the choices do not include killing, because killing was never mentioned as an option in the Quran while the only two options God mentioned were ransom and pardon.

Consequences:
Al-Jabri, in his book لا نسخ في القرآن...لماذا؟, pages 88-89, rejects this claim and discusses many negative consequences of accepting it. Among them is human rights violations, where a POW is abused or tortured. He also points out that ill treatment of POWs can only sew the seeds of hatred in them and in their people, something which will provoke future wars, and I add, Islamophobic campaigns that may reach up to genocide.

Rejecting this claim, on the other hand, means that we learn that God wants only two ways to deal with a POW: Pardon or ransom. Both lead to his release from captivity without indignation. That is more likely to correctly portray Islam as the religion of peace it is.

One verse in Chapter 50 was claimed abrogated by the sword verse:

According to Ibn Al-Jawzi who writes,

باب ذكر ما ادعي عليه النسخ في سورة ق. قوله تعالى "وما أنت عليهم بجبار". قال ابن عباس رضي الله عنهما لم تبعث لتجبرهم على الإسلام وذلك قبل أن يؤمر بقتالهم، قالوا ونسخ هذا بآية السيف

Translation: Ibn Abbaas said that 50:45 meant "you are not sent to obligate them to Islam. That was before he was ordered to fight them."

Al-Qaasim ibn Salaam, in his book الناسخ والمنسوخ في القرآن والسنة, page 156, quotes a clearer narration from Ibn Abbas saying that 9:5 and 9:29 abrogated 88:22, 50:45, 3:159, and 45:14.

The claim is invalid because the sword verse does not give a card blanche to the Prophet (PBUH) to intimidate all non-Muslims to accept Islam! It only orders fighting Arab polytheists in the Arabian peninsula who are combatant and only after the grace period following the expiration of peace treaties with them. A far cry from forced conversion.

Ibn Al-Jawzi reports that

ذكر الآية الثانية: قوله تعالى "فتول عنهم فما أنت بملوم". زعم قوم أنها منسوخة، ثم اختلفوا في ناسخها. فقال بعضهم آية السيف، وقال بعضهم إن ناسخها "وذكر فإن الذكرى تنفع المؤمنين". وهذا قد يخيل أن معنى قوله "فتول عنهم" أعرض عن كلامهم فلا تكلمهم. وفي هذا بعد فلو قال هذا إن المعنى أعرض عن قتالهم صلح نسخها بآية السيف. ويحتمل أن يكون معنى الآية أعرض عن مجادلتهم فقد أوضحت لهم الحجج وهذا لا ينافي قتالهم

He says that others claimed the abrogating verse was the next verse,

In his commentary on Aş-Şa`di Al-Yamaani's book التبيان في الناسخ والمنسوخ في القرآن المجيد, page 150, Dr. Abdullah Al-Husayni, identifies those as Ibn Salaama, Ibn Hazm Al-Andalusi and Abdul-Kareem Al-`Ataaiqi.

Ibn Al-Jawzi comments that this opinion would make sense only if 51:54 meant to stop talking to the disbelievers and that is far fetched. He says that if the meaning is to not fight then there may be a point about the sword verse claim. His own opinion is that the meaning is to stop arguing, which does not preclude fighting.

Dr. Az-Zalmi, in his book التبيان لرفع غموض النسخ في القرآن, page 400, says "stay away" does not preclude fighting when necessary. I'd add that only by reading the rest of the Quran can one know when fighting becomes necessary and when it is not. One verse does not a battle make.

While I concur with rejecting the claim, I don't actually see the verse ordering the Prophet to stop anything. I see it to mean "let them, you are not to blame for their disbelief." This does not preclude fighting them when they become hostile and neither does it preclude continuing to remind them, which is what 51:55 advises. All three verses are valid and they talk about different things without contradiction.

In his book نفس الصباح في غريب القرآن وناسخه ومنسوخه, volume 2, page 683, Al-Khazraji reports that Ad-Dhahhaak stated that the abrogating verse is also

Again, no point. Verse 51:44 does not command the Prophet (PBUH) to stop preaching, only to turn aside from those who reject his preaching. He was anxious to get everybody guided. He felt that if someone was not guided, he wouldn't have done his job! God assures him in 51:44 that this ain't so, for only believers will heed his message (51:45). Verse 5:67 addresses the other extreme: failing to preach for whatever concern.

باب ذكر ما ادعي عليه النسخ في سورة الطور. ذكر الآية الأولى: قوله تعالى "قل تربصوا فإني معكم من المتربصين". قال المفسرون معناها اتنظروا في ريب المنون فإني منتظر عذابكم فعذبوا يوم بدر بالسيف. وزعم بعضهم أنها منسوخة بآية السيف وليس صحيح إذ لا تضاد بين الآيتين.

ذكر الآية الثانية. قوله تعالى "فذرهم حتى يلاقوا يومهم الذي فيه يصعقون". في هذا اليوم ثلاثة أقوال: الأول أنه يوم موتهم. والثاني يوم النفخة الأولى. والثالث يوم القيامة. وقد زعم بعضهم أن هذه الآية منسوخة بآية السيف، وإذا كان معنى ذرهم الوعيد لم يقع نسخ.

ذكر الآية الثالثة: قوله تعالى "واصبر لحكم ربك فإنك بأعيننا". زعم بعض المفسرين أن معنى الصبر منسوخ بآية السيف وليس صحيح لأنه يجوز أن يصبر لحكم ربه ويقاتلهم ولا تضاد بين الآيتين


He dismisses all three claims. He says 52:31 and 52:48 do not contradict the sword verse and that 52:45 is a threat. In addition to my arguments about the sword verse which I explained many times before, Ibn Al-Jawzi's arguments are also correct. In addition, 52:48 is clearly timed.

Ibn Al-Jawzi reported that

باب ذكر ما ادعي عليه النسخ في سورة النجم. ذكر الآية الأولى: قوله تعالى "فأعرض عن من تولى عن ذكرنا". المراد بالذكر ها هنا القرآن وقد زعموا أن هذه الآية منسوخة بآية السيف

Translation: What is meant by the Remembrance here is the Quran. They claimed this verse abrogated by the sword verse.

Perhaps he got tired of how ridiculous those claims were. I feel the same way.

باب ذكر ما ادعي عليه النسخ في سورة القمر. قوله تعالى "فتول عنهم يوم يدع الداع". قال الزجاج الوقف التام فتول عنهم ويوم منصوب بقوله "يخرجون من الأجداث"، وقال مقاتل فتول عنهم إلى يوم يدع الداع. وليس هذا بشيء. وقد زعم قوم أن هذا التولي منسوخ بآية السيف وقد تكلمنا على نظائره وبينا أنه ليس بمنسوخ

He reports that Az-Zajjaaj explained that there is a mandatory pause after the words فتول عنهم which means that what follows is a new sentence. Muqaatil thought it was a continuous statement and Ibn Al-Jawzi dismisses his opinion.

Ibn Al-Jawzi reports that these two verse,

were claimed by Qataada and others to have been abrogated by the sword verse. This is what Ibn Al-Jawzi writes about it,

باب ذكر ما ادعي عليه النسخ في سورة الممتحنة. ذكر الأية الأولى والثانية: قوله تعالى "لا ينهاكم الله عن الذين لم يقاتلوكم في الدين" الآية، وقوله "إنما ينهاكم الله عن الذين قاتلوكم في الدين" الآية. زعم قوم أن هذا عام في جميع الكفار وأنه منسوخ بآية السيف. أخبرنا ابن ناصر قال أبنا ابن أيوب قال أبنا ابن شاذان قال أبنا أبو بكر النجاد قال أبنا أبو داود قال بنا محمد بن عبيد قال بنا محمد بن ثور عن معمر عن قتادة "لا ينهاكم الله عن الذين لم يقاتلوكم في الدين" قال نسختها "فاقتلوا المشركين حيث وجدتموهم". وقال غيره معنى الآيتين منسوخ بآية السيف. قال أبو جعفر ابن جرير الطبري لا وجه لادعاء النسخ لأن بر المؤمنين للمحاربين سواء كانوا قرابة أو غير قرابة غير محرم إذا لم يكن في ذلك تقوية لهم على الحرب بكراع أو سلاح، أو دلالة لهم على عورة أهل الإسلام، ويدل على ذلك حديث أسماء بنت أبي بكر رضي الله عنها لما قدمت عليها أمها قتيلة بنت عبد العزى المدينة بهدايا فلم تقبل هداياها ولم تدخل منزلها فسألت لها عائشة رسول الله صلى الله عليه وسلم فنزلت هذه الآية فأمرها رسول الله صلى الله عليه وسلم أن تدخلها منزلها وتقبل هديتها وتكرمها وتحسن إليها

Ibn Al-Jawzi reports Ibn Jareer At-Tabari's refutation of this claim by citing a hadeeth about Asmaa' bint Abi-Bakr. Her polytheist mother came to visit her and had gifts for her. Asmaa' did not take the gift and would not let her mother in the house. `Aa'isha asked the Prophet (PBUH) on behalf of Asmaa' and these verses were revealed. The Prophet ordered Asmaa' to let her mother in her house, accept her gift and be hospitable and kind to her.

This is exactly why the claims about the sword verse are bogus. The sword verse speaks of a very narrow set of polytheists: those who are hostile to Muslims and do not have a peace treaty with them. Extending its scope to all polytheists is unjustified and extending its scope to all non-Muslims is without any merit.

Al-Khazraji, in his book نفس الصباح في غريب القرآن وناسخه ومنسوخه, volume 2, pages 709-710, says that Ibn Zayd said the abrogating is

Which is a strange claim, since 58:22 specifically uses the verb حادّ which means to contravene or counteract. Those people are the opposite of the people 60:8 speaks about, so how can there be cause for claiming abrogation? The hadeeth of the Prophet (PBUH) to Asmaa' makes the distinction between the two people quite clear. A woman who came visiting and had a gift with her is not a woman who contravenes against God and His Messenger!

Al-Khazraji then finishes by saying that Mujaahid and the majority reject the claim and said that 60:8 was about those Muslims who stayed behind in Mecca. Al-Hasan said it was specifically about two tribes: Khuzaa`a and Banu Al-Harth ibn Abd-Manaaf.

Dr. Mustafa Zayd, in his book النسخ في القرآن الكريم, volume 2, pages 56-60 (items 776-778), quotes in full the opinion of An-Nahhaas, in his book الناسخ والمنسوخ, pages 235-237, who leans toward non-abrogation in this case. One of his statements is worth highlighting:

Abu-Ja`far An-Nahhaas wrote:
Verse 9:5 is not general about all polytheists and is not to be taken by its apparent meaning, so that Qataada is right. Rather, it is like

And it is established that the Prophet, peace be upon him, ordered cutting the hand in a quarter of a Dinar and up only. So, the verse applies to some thieves. The Messenger of God is the one who details God's commands.

Ibn Al-Jawzi reports that the verses

were abrogated. Some said they were abrogated by

and Muqaatil ibn Sulaymaan and Qataada claimed they were abrogated by the sword verse (9:5) and others, such as Judge Abu-Ya`la and Ahmad ibn Hanbal said they were abrogated but did not name the abrogating verse in Ibn Al-Jawzi's writing, which is this,

ذكر الآية الثالثة والرابعة: قوله تعالى "إذا جاءكم المؤمنات مهاجرات فامتحنوهن" الآية، وقوله "وإن فاتكم شيء من أزواجكم إلى الكفار فعاقبتم" الآية. كان رسول الله صلى الله عليه وسلم قد صالح مشركي مكة عام الحديبية على أن من أتاه من أهل مكة رده إليهم ومن أتى أهل مكة من أصحابه فهو لهم وكتبوا بذلك الكتاب، فجاءت امرأة بعد الفراغ من الكتاب. وفي تلك المرأة ثلاثة أقوال: الأول أم كلثوم بنت عقبة، والثاني السبيعة بنت الحارث، والثالث أميمة بنت بشر، فنزلت فامتحنوهن. وفيما كان يمتحنهن به ثلاثة أقوال: الأول الإقرار بالإسلام، والثاني الاستحلاف لهن ما خرجن من بغض زوج ولا رغبة عن أرض ولا التماس دنيا وما خرجن إلا حبا لله ولرسوله، والثالث الشروط المذكورة في قوله "إذا جاءك المؤمنات يبايعنك" فإذا أقررن بذلك لم يردهن إليهم.
اختلف العلماء هل دخل رد النساء إليهم في عقد الهدنة لفظا أو عموما. فقالت طائفة قد كان شرط ردهن في عقد الهدنة بلفظ صريح فنسخ الله تعالى ردهن من العقد وأبقاه في الرجال. وقالت طائفة لم يشرطه صريحا بل كان ظاهر العموم اشتمال العقد عليهن مع الرجال فبين الله عز وجل خروجهن عن عمومه وفرق بينهن وبين الرجال لأمرين: الأول أنهن ذوات فروج تحرمن عليهم، والثاني أنهن أرق قلوبا وأسرع تقلبا. فأما المقيمة على شركها فمردودة عليهم. وقال القاضي أبو يعلى إنما لم يرد النساء عليهم لأن النسخ جائز بعد التمكن من الفعل وإن لم يقع الفعل، فأما قوله وآتوهم يعني أزواجهن الكفار ما أنفقوا يعني المهر، وهذا إذا تزوجها مسلم، فإن لم يتزوجها أحد فليس لزوجها الكافر شيء. والأجور المهور.

"ولا تمسكوا بعصم الكوافر" وقد زعم بعضهم أنه منسوخ بقوله "والمحصنات من الذين أوتوا الكتاب" وليس هذا بشيء لأن المراد بالكوافر الوثنيات. ثم لو قلنا إنها عامة كانت إباحة الكتابيات تخصيصا لها لا نسخا، كما بينا في قوله "ولا تنكحوا المشركات".

وقوله "واسألوا ما أنفقتم" أي إن لحقت امرأة منكم بأهل العهد من الكفار مرتدة فسألوهم ما أنفقتم من المهر إذا لم يدفعوها إليكم "وليسألوا" يعني المشركين الذين لحقت أزواجهم بكم مؤمنات إذا تزوجن منكم من تزوجهن ما أنفقوا وهو المهر. والمعنى عليكم أن تغرموا لهم الصدقات كما يغرمون لكم "وإن فاتكم شيء من أزواجكم إلى الكفار فعاقبتم" أي أصبتموهم في القتال بعقوبة حتى غنمتم "فآتوا الذين ذهبت أزواجهم مثل ما أنفقوا" أي أعطوا الأزواج من رأس الغنيمة ما أنفقوا من المهر. أخبرنا إسماعيل بن أحمد قال بنا عمر بن عبيد الله قال أبنا ابن شاذان قال أبنا إسحاق بن أحمد قال بنا عبد الله بن أحمد قال حدثني أبي قال بنا عبد الوهاب عن سعيد عن قتادة قال: كن إذا فررن من المشركين الذين بينهم وبين رسول الله صلى الله عليه وسلم عهد إلى أصحاب نبي الله فتزوجوهن بعثوا بصداقهن إلى أزواجهن من المشركين الذين بينهم وبين رسول الله صلى الله عليه وسلم عهد، فإذا فررن من أصحاب رسول الله صلى الله عليه وسلم إلى كفار ليس بينهم وبين نبي الله صلى الله عليه وسلم عهد فتزوجوهن فأصاب المسلمون غنيمة أعطى زوجها من جميع الغنيمة ثم اقتسموا بعد ذلك، ثم نسخ هذا الحكم ونبذ إلى كل ذي عهد عهده وأمر بقتال المشركين كافة. قال أحمد وبنا أسود بن عامر قال بنا إسرائيل عن المغيرة عن إبراهيم في قوله "واسألوا ما أنفقتم وليسألوا ما أنفقوا" قال هؤلاء قوم كان بينهم وبين المسلمين صلح فإذا خرجت امرأة من المسلمين إليهم أعطوا زوجها ما أنفق. قال القاضي أبو يعلى وهذه الأحكام من أداء المهر وأخذه من الكفار وتعويض الزوج من الغنيمة أو من صداق قد وجب رده على أهل الحرب منسوخة عند جماعة من أهل العلم، وقد نص أحمد بن حنبل على هذا. وكذلك قال مقاتل بن سليمان كل هؤلاء الآيات نسختها آية السيف


He refutes the claim of 60:10-11 because the clause, "do not hold on to the knots of marriage of disbelieving women" means the polytheists, and even if it means all disbelieving women then 5:5 is an exemption not an abrogation, he says. I agree.

As for the claim about 5:5, it too is invalid, even though notable scholars such as Ibn Hanbal have ruled thus. The issue in dispute is whether Muslims who marry Muslim women who ran away from their disbelieving husbands, whether Muslims should repay the dowry back to the disbelieving husbands. Verse 60:11 makes it clear that they should and that it is "the definite ruling of God!" The sword verse, even if we concede that it ordered the indiscriminate fighting of all disbelievers, does not cancel this financial obligation. Muslims are still required to do the right thing to non-Muslims even as they fight them.

Dr. Az-Zalmi adds two names to those who claimed abrogation of these verses: Ibn Hazm Al-Andalusi and Ibn Salaama. He mentions that on pages 428-429 of his book التبيان لرفع غموض النسخ في القرآن. He refutes the claim on the basis that it was specific to the treaty of Al-Hudaybiya.

Abu-Abdillah Shu`la is terse in his book صفوة الراسخ في علم المنسوخ والناسخ but in this claim, he defends it in more than a page, pages 179-180. He is adamant that compensating polytheists for dowries they gave to their wives who fled them to Medina and became Muslims and married Muslims - that this compensation is no longer required. He says that the majority of the leading exegetes, the most senior scholars, Qataada, Ad-Dhahhaak, Mujaahid, Ibn Hanbal and Az-Zuhri all said so. He, however, criticizes a total claim of abrogation of 60:10-11. He sees abrogation of the compensation clause only, forgetting that abrogation must be total, per 2:106. Indeed, he has not mentioned that as a validation criterion of an abrogation claim.

The reason he does not want the abrogation claim to be total is because the clauses "test the migrating women", "there is no blame on you if you wish to marry them" and "do not hold on to the knots [of marriage] of disbelieving women" would all be abrogated as well.

Ibn Al-Jawzi reports one verse from Chapter 64 was claimed abrogate by the sword verse, namely,

He writes,

باب ذكر ما ادعي عليه النسخ في سورة التغابن. قوله تعالى "وإن تعفوا وتصفحوا وتغفروا فإن الله غفور رحيم". أخبرنا المبارك بن علي قال أبنا أحمد بن الحسين قال أبنا البرمكي قال أبنا محمد بن إسماعيل قال أبنا أبو بكر بن أبي داود قال بنا يعقوب بن سفيان قال بنا عبد الله بن صالح قال حدثني معاوية بن صالح عن علي بني أبي طلحة عن ابن عباس رضي الله عنهما "وإن تعفوا وتصفحوا وتغفروا" ونحو هذا من القرآن مما أمر الله به المؤمنين بالعفو عن المشركين فإنه نسخ ذلك قوله "فاقتلوا المشركين حيث وجدتموهم".
قلت قد روينا عن جماعة من المفسرين منهم ابن عباس رضي الله عنهما أن سبب نزول هذه الآية أن الرجل كان إذا أراد أن يهاجر من مكة إلى المدينة منعته زوجته وولده وعلى هذا يمكن أن يكونوا قد آمنوا معه ولكنهم يمنعونه حبا لإقامته فلا يتوجه نسخ

He reports that Ibn Abbaas said this verse and all others that order Muslims to pardon the polytheists were all abrogated by the sword verse. He also reports that Ibn Abbaas said the circumstance of revelation of this verse was that a man would want to migrate from Mecca to Medina but his wife and children would stop him because they wanted him with them. Ibn Al-Jawzi says that proves that there is no abrogation here.
