Dr. Mustafa Zayd, in his book النسخ في القرآن الكريم, volume 2, pages 263-264 (item 1152), writes that An-Nahhaas write that some scholars he did not name have claimed that
was abrogated by consensus! He said that scholars have agreed that the leader does not have to take such oath from migrating Muslim women. Dr. Zayd quickly dismisses this claim since consensus, he asserts, cannot possibly abrogate a verse.
I certainly agree, but would like to draw attention to the fact that the verse addresses the Prophet (PBUH), so it does not imply a mandate on subsequent Muslim leaders, unless by extrapolation.
An-Nahhaas mentions that Abu-Haatim agrees with the consensus but does not consider this abrogation. Instead, he opined that it is case of إطلاق الترك (leaving the matter to the leader's discretion). He recited 2:106 as Ibn Abbaas did, as ننسأها (put it off), but he understood the verb to mean to leave the matter open to discretion. An-Nahhaas likes that. I don't know on what basis can the verb be interpreted that way.
