Al-Khazraji, in his book نفس الصباح في غريب القرآن وناسخه ومنسوخه, volume 2, page 484, says that those who opine that the actions of prior prophets apply to us have said that
was abrogated by a hadeeth of the Prophet (PBUH) in which he said, "No silence a whole day till the night." Narrated by Ali and reported by Abu-Daawood.
This is a different claim from the one we discussed in the topic "
Did the Sunna abrogate 3:41?". That one was clearly a statement of fact, while this one is an imperative statement. In 3:41, Zacharaiah was told he won't
be able to speak, but in 9:26, Mary was told not to speak.
There is some merit to this claim, which almost nobody made! However, Al-Khazraji gave an easy way to refute it: the commands given to prior nations do not necessarily apply to us. We only know the ones that do because either God or His Messenger said they do.
Furthermore, No hadeeth can abrogate a verse, as most scholars have agreed.
