Ibn Al-Jawzi reports that Al-Hasan, Ataa' and Ad-Dhahhaak, among others, said that

was abrogated by

While Mujaahid and Qataada said it was the other way around. Jaabir ibn Zayd and the majority are of the opinion that both verses are unabrogated and offer two options for the Muslim leader. Here is what Ibn Al-Jawzi wrote,

ذكر الآية الثانية: قوله تعالى "فإذا انسلخ الأشهر الحرم فاقتلوا المشركين حيث وجدتموهم". قد ذكروا في هذه الآية ثلاثة أقوال:

الأول أن حكم الأسارى كان وجوب قتلهم ثم نسخ بقوله "فإما منا بعد وإما فداء"، قاله الحسن وعطاء والضحاك في آخرين. وهذا يرده قوله "وخذوهم" والمعنى أئسروهم.
والثاني بالعكس، فإنه كان الحكم في الأساري أنه لا يجوز قتلهم صبرا وإنما يجوز المن أو الفداء بقوله "فإما منا بعد وإما فداء"، ثم نسخ ذلك بقوله "فاقتلوا المشركين"، قاله مجاهد وقتادة.
والثالث أن الآيتين محكمتان لأن قوله "فاقتلوا المشركين" أمر بالقتل وقوله "وخذوهم" أي ائسروهم، فإذا حصل الأسير في يد الإمام فهو مخير إن شاء من عليه وإن شاء فاداه وإن شاء قتله صبرا، أي ذلك رأى فيه المصلحة للمسلمين، فعلى هذا قول جابر بن زيد وعليه عامة الفقهاء.

وقد ذكر بعض من لا فهم له من ناقلي التفسير أن هذه الآية وهي آية السيف نسخت من القرآن مائة وأربعا وعشرين آية ثم صار آخرها ناسخا لأولها وهو قوله "فإن تابوا وأقاموا الصلاة وآتوا الزكاة فخلوا سبيلهم" وهذا سوء فهم لأن المعنى اقتلوهم وأسروهم إلا أن يتوبوا من شركهم ويقروا بالصلاة والزكاة فخلوا سبيلهم ولا تقتلوهم


In the above, Ibn Al-Jawzi ridicules those who said that the sword verse abrogated 124 verses then abrogated itself.

Against:
Jaabir ibn Zayd,
The majority, according to Ibn Al-Jawzi,
