Ibn Al-Jawzi reports, with criticism, that some claimed that

was abrogated by


Here is what he writes,

ذكر الآية الثامنة: قوله تعالى "ولمن انتصر بعد ظلمه فأولئك ما عليهم من سبيل". زعم بعض من لا يفهم أنها نسخت بقوله "ولمن صبر وغفر إن ذلك لمن عزم الأمور". وليس هذا بكلام من يفهم الناسخ والمنسوخ، لأن الآية الأولى تثبت جواز الانتصار وهذه تثبت أن الصبر أفضل


He correctly dismisses the claim saying that 42:41 allows seeking justice after being wronged and 42:43 states that forgiveness is better.

I'd add that 42:43 is not really a ruling, but a statement of praise. It lauds a person who is able to endure offenses and not hold a grudge. As I mentioned in this post, that does not preclude seeking justice and rectification of the wrong, in a court of law for instance.

Dr. Ali Jum`a, in his book النسخ عند الأصوليين, page 86, adds this verse to the claim, which he refutes as well,

Al-Khazraji, in his book نفس الصباح في غريب القرآن وناسخه ومنسوخه, volume 2, page 641, confirms it and says that it was Ibn Zayd who made the claim. Al-Khazraji says that An-Nahhaas and Makki said it was not abrogated.

Al-Jabri rejects the claim made by Ibn Hazm Al-Andalusi that 42:43 abrogated 42:39-42. He says, in his book لا نسخ في القرآن...لماذا؟, page 122, that 42:39-42 state that self defense is legitimate, retaliation must be equal to the offense and seeking vindication is blameless. What 42:43 says is to state the nobler thing to do. That's not abrogation, it's a praised option for those who can find it in themselves to do.

I fully agree. It would be abrogation if self defense and seeking justice are no longer allowed.

Abu-Abdillah Shu`la, in his book صفوة الراسخ في علم المنسوخ والناسخ, pages 169-170, rejects this claim and quotes scholars whom he did not name (Dr. Faaris implies he may have meant Makki) arguing that 42:39 and 42:43 speak of two different issues. One praises vindication and another praises endurance, but endurance and pardoning are saintly, as they require high resolve.

Indeed, both are praiseworthy and therefore allowed.

Shu`la also mentions another refutation argument, without reference, which is quite simple: vindication can only happen after injustice is done! This is relevant, because Ibn Zayd, who accepts this claim, had argued that the Jihaad orders abrogated 42:39 because they allowed starting a fight. Thus, Ibn Zayd, implied that Jihaad is meant to prevent future injustice!

Jihaad, of course, is never done by starting a fight. Only trigger-happy people think otherwise. We know that because God has made it clear as daylight:
