Two remarks:

1. The reason this may be considered proof is that the conditional article إذا (if) used in this verse is stronger in asserting that the condition would actually occur, compared to the other two conditional articles إن and لو

2. Nonetheless, what 16:101 definitively asserts is the adversary reaction to the substitution, not the substitution itself. The verse is really giving the Prophet (PBUH), and the Muslims in general, moral support by anticipating the adversary reaction so it is discounted when it actually occurs.

Opinion of Imam Al-Shafeiy

We know that the great Imam Al-Shafeiy "الشافعي" was pro-abrogation. His opinion about the wisdom of abrogation was quoted in volume 1 of this book, item 382, page 270. Like many writings of Muslim scholars, a good part of the statement is preaching and supplication. May God reward him for the substantial body of knowledge he contributed. Here is a translation of the quote:

"God has created all creatures according to His prior knowledge of what He wanted out of creating them and out of them. There is no second guessing of His judgment. He is quick in His accounting.

And He sent down the Book explaining everything and as guidance and mercy, and decreed in it duties that He fixed, and others that He abrogated, as a mercy to His creation, by easing things on them and leaving them some room, adding to what He initially had given them of blessings, and rewarded them for observing the rules He fixed on them with His paradise and escape from His torment. Thus His mercy has surrounded them in what He fixed and what He abrogated. Praise Him for His blessings."

When it comes to the details, Imam Shafeiy held three restrictive views regarding abrogation:

  • He was the first notable scholar to assert that exception and elaboration do not constitute abrogation, and to articulate that "lifting of the ruling of a text" is a requirement for abrogation (item 99 on page 75).

  • He required that a replacement be there if an abrogation is to be claimed (item 273 on page 183).

  • He disallowed abrogation of the Quran by the Sunna or by any means other than the Quran itself (item 291 on page 197).

In some of the non-Muslim literature, Imam Al-Shafeiy is given the major credit for establishing the intellectual basis for theological sciences in Islam. His role in the abrogation doctrine is considered paramount, whereas Imam Abu-Haneefa who preceded him and employed a broader use of abrogation is given far less 'credit'. Perhaps it is because Al-Shafeiy's definition of abrogation is really that of annulment, while Abu-Haneefa covers many reconciliation techniques under the umbrella of the term 'abrogation'.

The interesting angle that is postulated in this literature is that Al-Shafeiy was reacting to a culture where tradition was treated as a source of Islamic jurisprudence, and traditions had varied according to the different municipalities of the centers of Islam. He was adamant that the only real sources are the Quran and the Sunna of the Prophet (PBUH), as the word Sunna at the time was used to cover tradition of Sahaba and those who came after them as well. His influence was decisive in both restricting what Sunna meant and in elevating its role.

Therefore, Al-Shafeiy's main efforts can be seen as attempts to restrict something that has gone out of control, and to put discipline in it. His views on abrogation may be viewed in the same light since the notion had been expanded as well by the Hanafi school. This may explain the rather unusual dichotomy that Al-Shafeiy pioneered in insisting that Quran abrogates Quran and Sunna abrogates Sunna but no cross abrogation of any kind is allowed (although the author on page 100 says that Al-Shafeiy doesn't explicitly say that Quran cannot abrogate Sunna, but that he says explicitly that Sunna cannot abrogate Quran). Precluding that Quran could abrogate Sunna is a somewhat unusual condition for someone who believes in the principle of abrogation in the first place, and it can be seen as an attempt to preempt relegating the Sunna to being less authoritative, something Al-Shafeiy was keen on avoiding. Disclaimer: The last three paragraphs in this post are based on non-Muslim analysis of events, and should be viewed in this light.

Dr. Mustafa Ibraheem Az-Zalmi started his book, التبيان لرفع غموض النسخ في القرآن, as follows,

الحمد لله الذي أحاط علمه بما يجري في الأزمنة الثلاثة، وأخضع لإرادته المتغيرات الكونية والمستحدثات البشرية، وأنهى تعديلات تشريعاته بدستور يتسم بطابع الثبات والخلود، والصلاة والسلام على خاتم الأنبياء الذي اختتمت به رسالاتهم. وعلى آله وأصحابه الذين أدركوا أسرار القرآن وعبدوا طريق فهمه وتطبيقه لمن يأتي بعدهم من بني الإنسان.

أما بعد فإن أهم الدوافع التي دفعتني لتقديم هذا الجهد المتواضع رغم سوء حالتي الصحية كثيرة منها:

١- تنبيه من يدافع عن وجود النسخ في القرآن - بحسن ظنه - على أنه لن يخدم بهذا الدفاع سوى أعداء الإسلام ممن طعنوا في مؤلفاتهم القرآن بالنسخ محتجين بأن النسخ من سمات تشريعات تكون من صنع الإنسان.

٢- إبراز الخلط القائم بين النسخ بمعناه العام عند السلف الصالح الشامل لكل ما يطرأ على النص من تخصيص أو تقييد أو تفصيل أو تخفيف أو نحو ذلك وبين النسخ بمعناه الخاص الذي استحدثه علماء الأصول المتأخرون وهو إلغاء حكم سابق بدليل شرعي لاحق.

٣- الإيمان بالقرآن الكريم يأتي مباشرة بعد الإيمان بالله، وقد أجمع العلماء المسلمون قديما وحديثا على عدم جواز الاعتماد على الظنيات في المعتقدات بالاجتهادات ولا باتباع المسالك التقليدية لأن الإيمان التقليدي وكل ما قيل بصدد نسخ القرآن لا يستند إلا إلى الأدلة الظنية.

٤- بعد مراجعة مئات المراجع المعتمدة من تفاسير القرآن والحديث الشريف وشروحه وكتب أصول الفقه والمؤلفات القديمة والحديثة بشأن النسخ في القرآن لم أجد دليلا قطيعا من آية قرآنية أو سنة نبوية متواترة أو إجماع الصحابة أو أقوال كتاب الوحي البالغ عددهم أكثر من أربعين صحابيا يدل على نسخ آية معينة بآية أخرى أو بسنة متواترة، فكل ما كتب وقيل ليس إلا دليلا ظنيا مختلفا فيه مستنتجا من خبر الآحاد أو الاجتهادات الشخصية أو الدلالات الظنية للنصوص، فقد أجمع علماء الإسلام قديما وحديثا على أن ما ثبت باليقين لا يزول إلا باليقين


Brief translation:
1- Defense of abrogation only serves the enemies of Islam, who attacked the Quran on the basis that abrogation is something that creatures have to do, not God.
2- There is a difference in definition of "naskh" between the time of the Sahaaba and their followers and modern times. The older generations defined "naskh" as everything that augments an existing ruling. Modern scholars defined it as abrogation, i.e., replacement of a ruling by a later one.
3- Faith cannot depend on less than certain evidence. Faith in the Quran comes second only to faith in God.
4- After reviewing hundreds of exegesis books, hadeeth studies, jurisprudence fundamentals, old and new literature, I could not find even one definitive evidence, be it a verse, a ubiquitous hadeeth, consensus of the Sahaaba, words of those who inscribed the Quran (there were more than forty of them), not one definitive evidence that any verse in the Quran was abrogated by any other verse. What is proven by definitive evidence, such as the text of the Quran, cannot be removed except by equally definitive evidence, said the consensus of the scholars old and new.

In his review of Dr. Az-Zalmi's book, التبيان لرفع غموض النسخ في القرآن, Dr. Hasan Ali Azh-Zhanoon (حسن علي الذنون) writes,

بدأ الأستاذ الكبير بتحديد مفهوم النسخ واستبعاد ما ليس منه، فالنسخ عبارة عن رفع حكم شرعي بدليل تراخ، هذا هو (النسخ) بمعناه الدقيق أما تخصيص العام وتقييد المطلق والاستثناء والرخصة بعد العزيمة فليس من النسخ في شيء.
عرض الأستاذ الكبير لأسباب المغالاة في القول بنسخ القرآن، وحصرها في سبعة عشر سببا، كما عرض لقول بعضهم أن آية السيف نسخت (144) آية من آيات القرآن وأن آخر هذه الآية نسخ أولها؟!! وقال إن مجموع آيات القرآن الكريم (6204) آيات ذهب بعضهم إلى أن المنسوخ منها (564) آية أي ما يقارب عشر آيات القرآن الكريم، أفينسجم هذا الرأي مع ما ينبغي آن يحاط به كلام الله من تقديس واحترام وتنزيه عن اللغو والكذب!!
الواقع أن هذا النفر من الفقهاء أساءوا الأدب مع الله بفتحهم الباب على مصراعيه أمام أعداء الإسلام وأمام أولئك الذين يخلطون بين النسخ والبداء وبين النسخ والإنساء وبين نسخ الأحكام ونسخ الأخبار.
لم يكتف الأستاذ الكبير بتحديد مفهوم النسخ وشروطه ونطاقه وأنواعه وعرض كل هذه المسائل والأبحاث عرضا واضحا رائعا لا تكاد تحظى بمثله في أي مرجع اخر، وإنما عهد إلى استعراض الآيات التي زعموا انها منسوخة. فقد عرض لآكثر من خمسين آية مبتدئا منها بما ورد في سورة البقرة منتهيا بما ورد في سورة (الكافرون). سلط على هذه الآيات التي زعموا بأنها منسوخة ما أفاء الله عليه من علم غزير بالفقه وأصوله وبالبلاغة والمنطق وبالفلسفة وعلم الكلام وما حباه الله من إيمان صادق وعقل نير وغيره على الإسلام وعلى كتاب الله جل وعلا، فناقش من زعم أنها آيات منسوخة وفند زعمهم هذا بما يجعلك تخرج وأنت مطمئن القلب قرير العين ثابت الإيمان لكتاب الله العزيز في قلبك المكانة التي يجب ان تحتلها في قلب كل مؤمن صحيح الايمان.

هذه نظرة طارئة إلى هذا المؤلف الجليل الذي يعتبر في نظري فتحا فتح الله له قلب هذا الاستاذ الكبير المجاهد المؤمن داعيا المولى عز وجل له دوام الصحة والعافية وطول العمر وأن يحفظه المولى ذخرا للعلم وعلما نيرا من أعلام الإسلام


Another review of the book comes from Shaykh Yaaseen Saalih Abd-ul-Kareem. He writes,

لقد قرأت مغتبطا تلك الخطوة التي خطاها الأستاذ الكبير الدكتور مصطفى ابراهيم الزلمي في مؤلفه (التبيان لرفع غموض النسخ في القرآن) إذ قرر مشكورا أن يسلط بعض الأضواء على الكتب والبحوث التي تناولت مسألة الناسخ والمنسوخ في القرآن الكريم. وقد تبين لي أن الدكتور مصطفى في كتابه المذكور لم ينكر النسخ كما هو واضح في عنوان كتابه، وإنما صحح مفهوم النسخ، وهذا الاتجاه الصحيح ينبغي أن يزكيه كل مشتغل بالدراسات الاسلامية وأن يقدم كل عالم خبرته ورأيه في تعزيز هذا الاتجاه لأن كثيرا من الكتب المؤلفة في العلوم الاسلامية في حاجة إلى التمحيص والتنقيح والتصحيح، وإن الذين كتبوا في ناسخ القرآن ومنسوخه قد خلطوا بين النسخ بمعناه العام والنسخ بمعناه الخاص حتى وصل بهم الحال عدوا التخصيص والتقييد نسخا والاستثناء نسخا وبين هذه الاشياء وبين النسخ فروق معروفة وللناسخ والمنسوخ أمثلة كثيرة إلا أن العلماء في هذا أصناف:
١- منهم المكثر الذي اشتبه عليه الأمر فأدخل في النسخ ما ليس منه.
٢- ومنهم المتحري الذي يعتمد على النقل الصحيح في النسخ.
ومنشأ الاشتباه عند المكثرين أمور أهمها:
١- اعتبار التخصيص نسخا.
٢- اعتبار البيان نسخا
٣- اعتبار ما شرع لسبب زال السبب من المنسوخ كالحث على الصبر وتحمل أذى الكفار في مبدأ الدعوة حين الضعف والقلة قالوا إنه منسوخ بآيات القتال والحقيقة أن الحكم الأول هو وجوب الصبر والتحمل كان ويكون لحالة الضعف والقلة وإذا وجدت الكثرة والقوة وجب الدفاع عن العقيدة بالقتال وهو الحكم الثاني.
٤- اعتبار ما أبطله الإسلام من أمر الجاهلية أو من شرائع الأمم السابقة نسخا كتحديد عدد الزوجات بأربع ومشروعية القصاص والدية وقد كان عند بني إسرائيل القصاص فقط كما قال ابن عباس رضي الله عنه، رواه البخاري، ومثل هذا ليس نسخا وإنما هو رفع للبراءة الأصلية

The views of Imam Malik

The towering figure Imam Malik Ibn Anas is seldom quoted in the abrogation literature. This is particularly notable in Zaid's book, since the author is reported to have been a great admirer of Malik. Imam Malik was a revered teacher of Imam Al-Shafeiy, whose views on abrogation were discussed in an earlier post of this thread.

From what I have read so far, there seems to be two clear facts. Malik did discuss the idea of abrogation, but he did not use the word "نسخ" in doing so (the word is reported to have appeared only once in his famous book Al-Muatta'). In the context of discussing the license of a traveler to break his fast and make up for it later on, Malik addressed the idea of chronologically later sources trumping earlier sources.

A teacher of Malik, Muhammad ibn Muslim ibn Ubaydullah ibn Shihab Al-Zuhri (ابن شهاب الزهري‎), who is reportedly one of the pioneers of Islamic scholarship, has been falsely attributed a book called Naskh al-Qur-ān, according to Western literature. Zaid also talks about false attribution to Al-Zuhri on page 285 of volume 1 of his book.

Another time he may have used it, according to Ibn Al-Jawzi as quoted in this post, is when he stated that a part of 2:233 was abrogated.

It also appears that he believed that the Sunna can abrogate verses of the Quran, according to Al-Qurtubi as quoted in this post.

Yes, I recall reading that it was a point of difference or contention between teacher and student (Al-Shafeiy) later on. What is clear is that Malik wasn't dealing with the subject as a doctrine, neither in magnitude nor in terminology, but rather as an arbitration method in isolated instances. He may well have been talking about reconciliation rather than annulment.

On page 207, Burton comments in his conclusion that Al-Asfahani's scholarship "fell short of the piety of his motives." He went on to describe Muhammad Abduh's efforts to deal with the issue as he viewed it as a vulnerable point of attack by the enemies of Islam. Burton said that Abduh adopted Al-Asfahani's definitions in these efforts.

This is an interesting comment because Burton clearly attacks the abrogation doctrine as unjustified, and details its historical and logical weaknesses. Yet, he is basically saying in the conclusion that the anti-abrogation scholars also failed to provide a compelling argument for their case. This makes it clear that we need to really get this right, otherwise we would be joining the endless mud slinging that has characterized this subject and has been both sub-scholarly and inconclusive.

In his book, الناسخ والمنسوخ, Al-Muqri has harsh words for those who take an anti-abrogation stance. He writes,

وقال آخرون لا يعد خلافهم خلافا: ليس في القرآن ناسخ ولا منسوخ. وهؤلاء قوم عن الحق صدوا وبإفكهم على الله ردوا باب ما رد الله على الملحدين والمنافقين من أجل معارضتهم في تنقل أحكام كتابه المبين. قال الله تعالى "ما ننسخ من آية أو ننسها نأت بخير منها أو مثلها"، قال الشيخ أبو القاسم هبة الله: وهذه الآية يحتاج مفسرها الى أن يقدرها قبل تفسيره لها، لأن فيها مقدما ومؤخرا تقديره، والله أعلم، ما نرفع من حكم آية نأت بخير منها أو ننسها أي نتركها فلا ننسخها. وقد اعترض في هذا التأويل، فقيل في القرآن ما بعضه خير من بعض؟ أليس بكلام واحد جل قائله؟ فالجواب أن معنى "خير منها" أي أنفع منها، لأن الناسخ لا يخلو من إحدى النعمتين: إما أن يكون أثقل في الحكم فيكون أوفر في الأجر، وإما أن يكون أخف في الحكم فيكون أيسر في العمل ومن قرأها ننسأها أي نؤخر حكمها فيعمل بها حينا ثم قال تعالى "ألم تعلم أن الله على كل شيء قدير" اهـ

He makes a number of points I want to highlight:
  1. Denying abrogation is equivalent to denying God the argument He used to answer the atheists and the hypocrites, who objected to the changes in rulings in the Book.
  2. Before attempting to interpret 2:106, one has to understand that there is an intended reference, which, he guesses, is the ruling of a verse.
  3. That "cause it to be forgotten" means to leave it unabrogated.

The first point highlights why the early scholars were so passionate about defending the abrogation doctrine! They feared the arguments of the Jews and the polytheists (whom are probably what he meant by atheists).

The second point is,as he himself admitted, is conjecture.

The third point is a new one to me that I haven't seen before in the literature, and a rather strange one at that.
